PARTICIPANT WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT
By signing this agreement, I acknowledge that I am voluntarily participating in a tour operated by Rennell Sound Adventures. I fully understand the nature of this outdoor activity and the potential risks involved.
1. ACKNOWLEDGEMENT OF RISKS
I acknowledge and understand that participating in the Rennell Sound tour involves potential risks, including but not limited to:
Natural Hazards: Uneven, rocky, slippery, or unstable terrain, fallen trees, loose rocks, and coastal tides.
Weather Conditions: Exposure to wind, rain, cold temperatures, or sudden weather changes.
Wildlife Encounters: Possible encounters with animals such as bears, cougars, eagles, and marine life.
Physical Activity: Walking on rugged trails, climbing over obstacles, or standing for extended periods.
Medical Risks: Risk of injury from falls, insect bites, allergic reactions, dehydration, or exhaustion.
Remote Location Risks: Limited access to medical facilities and possible delays in emergency response.
Transportation Risks: Traveling on winding gravel roads, potential vehicle breakdowns, or road hazards.
I understand that Rennell Sound Adventures takes precautions to ensure safety but cannot eliminate all risks associated with outdoor activities.
2. ASSUMPTION OF RISK
I acknowledge that my participation in this tour is entirely voluntary. I freely and knowingly accept all risks associated with this activity, including those that may result in personal injury, illness, property damage, or even death.
I confirm that I:
Am physically able to participate in this activity.
Have disclosed any medical conditions that could affect my participation.
Will follow all instructions given by the guide.
Am responsible for wearing appropriate clothing and footwear for the conditions.
3. RELEASE OF LIABILITY & WAIVER OF CLAIMS
To the fullest extent permitted by law, I release, waive, and discharge Rennell Sound Adventures, its owner(s), employees, contractors, affiliates, and any related parties from any and all liability for injuries, damages, or losses arising from my participation in this tour.
This waiver includes claims related to:
Negligence (except gross negligence or intentional misconduct).
Accidents or injuries occurring during travel, hiking, or beach exploration.
Property damage or loss of personal belongings.
Delays, cancellations, or itinerary changes due to unforeseen circumstances.
I agree that I will not file a lawsuit or make any claims against Rennell Sound Adventures for any injury, loss, or damage I may experience.
4. MEDICAL CONSENT & EMERGENCIES
In the event of an accident or medical emergency, I authorize Rennell Sound Adventures to seek medical assistance on my behalf. I understand that I am responsible for any medical expenses incurred.
5. AGREEMENT & SIGNATURE
I confirm that I have read and fully understand this waiver. I acknowledge that by signing, I am waiving certain legal rights, including the right to sue.
